Terms of Service

Exponential Leadership is an executive coaching, leadership development and digital transformation practice operated based in Leiden, the Netherlands. References to "Exponential," "we," "us" or "our" throughout these Terms refer to Exponential Leadership and its representatives.

Our contact details are set out at the end of this document and on our Contact page.

Exponential Leadership is registered in the Netherlands and operates in compliance with applicable Dutch and European law, including the General Data Protection Regulation (GDPR) as it applies to our services.

Accepting These Terms

By accessing or using our website, booking a service, or entering into a coaching or development engagement with us, you agree to be bound by these Terms of Service, together with our Privacy Policy, which is incorporated by reference.

If you are accessing our services on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms. In that case, references to "you" in these Terms apply to both you personally and to the organisation you represent.

If you do not agree with any part of these Terms, please do not use our website or services. If you have questions before proceeding, we welcome you to contact us.

Service	Bookings	Cancellations
Free 30 Minute Explore Session	Book directly through the website	The Explore Session is a complimentary 30-minute conversation offered at no charge and with no obligation. Booking an Explore Session does not constitute a contractual commitment by either party. Cancellation or rescheduling of an Explore Session can be made at any time via the booking system.
Executive Coaching Package	Book directly through the website. Bookings are confirmed once full payment is received.	More than 48 hours' notice: full reschedule or refund, no charge 24–48 hours' notice: 50% of the session fee is retained; the session may be rescheduled once at no additional cost Less than 24 hours' notice, or non-attendance: the full session fee is retained Where a booking includes a Hogan or Leadership Circle assessment, the assessment is commissioned and administered on your behalf following booking confirmation. Assessment costs are non-refundable once an assessment has been commissioned, as the cost is incurred with the assessment provider at that point. We will always confirm before commissioning an assessment that you wish to proceed.
Bespoke Individual Coaching	Design of bespoke individual coaching will be confirmed in a separate coaching agreement that will set out the details of the coaching, following these booking and cancellation terms, unless specifically otherwise agreed. Group Coaching Packages	Book directly through the website. Bookings are confirmed once full payment is received.	Our Group Coaching packages include both individual and group sessions. The Group Sessions are provided on a fixed day and time, and cannot be rescheduled. Non-attendance at a Group Session impacts both your coaching journey, and the coaching journey of the other participants. Non-attendance at the Group Sessions is non-refundable. Individual elements of the Group Coaching Packages may be rescheduled in line with the terms for individual coaching, such that the timing of the individual sessions remains sequential with the entire coaching trajectory - that is: the program provides for dates and times during which individual sessions may take place, ensuring the overall coaching program is assured. Group Coaching participants are responsible for ensuring they book their individual sessions in line with the times provided in the overall program, and may reschedule times once per program.
Bespoke Group Coaching	Design of bespoke group coaching will be confirmed in a separate coaching agreement that will set out the details of the coaching, following these booking and cancellation terms, unless specifically otherwise agreed.	More than 30 days' notice: no charge for work not yet commenced. Work already commenced (including design work) willl be invoiced on the basis of a pro-rata program fee. 15 - 30 days' notice: 50% of the remaining program fee is charged and payable by the client. Leadership Assessments (Leadership Circle or Hogan)	Book directly through the website, payment is required upfront to commission the assessment.	More than 48 hours' notice: full reschedule or refund, no charge 24–48 hours' notice: 50% of the session fee is retained; the session may be rescheduled once at no additional cost Less than 24 hours' notice, or non-attendance: the full session fee is retained. Leadership Development Programs	Design of leadership development programs will be confirmed in a separate agreement that will set out the details of the program, following these booking and cancellation terms, unless specifically otherwise agreed. Public AI and Digital Transformation Events	Book directly through the website or our event site. Bookings are confirmed once full payment is received.	Due to the high demand and limited seats available for public events, we do not provide full refunds for cancellations. More than 48 hours' notice: 50% of the session fee is retained; the session may be rescheduled once at no additional cost Less than 24 hours' notice, or non-attendance: the full session fee is retained Where a booking includes a Hogan or Leadership Circle assessment, the assessment is commissioned and administered on your behalf following booking confirmation. Assessment costs are non-refundable once an assessment has been commissioned, as the cost is incurred with the assessment provider at that point. Bespoke AI and Digital Transformation Programs	Design of bespoke AI and Digital Transformation programs will be confirmed in a separate agreement that will set out the details of the program, following these booking and cancellation terms, unless specifically otherwise agreed. Team and Strategy Offsite Design and Facilitation	Design and facilitation of Team and Strategy Offsites will be confirmed in a separate agreement that will set out the agreed details of delivery, following these booking and cancellation terms, unless specifically otherwise agreed. Innovation Session Design and Facilitation	Design and facilitation of Innovation Sessions will be confirmed in a separate agreement that will set out the agreed details of delivery, following these booking and cancellation terms, unless specifically otherwise agreed. Fees and Payments

Fees for all services are as stated in the relevant proposal, product description or engagement agreement. All fees are quoted exclusive of VAT (BTW) unless otherwise stated. VAT will be applied at the applicable Dutch rate where required by law.

Exponential Leadership issues invoices by email or via our booking and payment system. For coaching products, events and standard packages, payment is due as specified at the time of booking — typically in advance of the session.

For organisational engagements, invoicing schedules are agreed in the engagement agreement. Payment is due within 14 days of the invoice date unless otherwise agreed in writing.

Exponential Leadership reserves the right to suspend services where payment remains outstanding beyond the agreed period. Late payments may be subject to statutory interest in accordance with Dutch law (Wet handelsrente).

Expenses

Where in-person facilitation or delivery requires travel, accommodation or other reasonable expenses, these are billed at cost unless otherwise agreed in the engagement agreement. Expenses are invoiced separately and on presentation of receipts where requested.

Confidentiality

Confidentiality is a foundational principle of the Exponential Leadership coaching practice — not a contractual formality.

What Exponential keeps confidential

Everything discussed in a coaching, facilitation or advisory session is treated as strictly confidential. We will not disclose the content of any coaching conversation, assessment result or personal disclosure to any third party without your explicit written consent — including, where relevant, to the organisation that commissioned your coaching.

The limited exceptions to this are:

Where you have explicitly requested or consented to a specific disclosure
Where we are required to disclose information by law or by a court order
Where there is a reasonable belief of a serious risk of harm to you or to another person — in which case we will, wherever possible, discuss this with you before taking any action
For the purposes of professional supervision, where your information will be anonymised

Assessment results

Where an assessment (Hogan or Leadership Circle) is commissioned by an organisation rather than by you personally, the scope of any reporting to the commissioning organisation is agreed with you in advance and confirmed in writing before the assessment is administered. No assessment data is shared beyond the agreed scope.

What you keep confidential

Where you receive confidential information about Exponential Leadership's methodologies, materials, program design or pricing in the course of an engagement, you agree to treat this information as confidential and not to share it with third parties without our written consent.

Intellectual Property

All content on the Exponential Leadership website (including, by extension, our booking sites for coaching and events) — including text, design, program descriptions, frameworks, methodologies and materials — is the intellectual property of Exponential Leadership unless otherwise stated. You may not reproduce, distribute, adapt or use any part of this content for commercial purposes without our prior written consent.

Materials created specifically for you as part of a coaching or development engagement — such as a written development plan, session notes or bespoke program design — are provided for your personal or organisational use. They may not be reproduced commercially or shared with third parties in a way that competes with Exponential Leadership's services.

Third-party tools and frameworks used within Exponential Leadership's services — including the Leadership Circle 360° and Hogan assessments — remain the intellectual property of their respective owners and are used under licence. Nothing in these Terms grants you any rights in those tools beyond what is provided as part of your engagement.

Website Use and Availability

You may use the Exponential Leadership website for its intended purpose — learning about our services, booking sessions and contacting us. You agree not to use the website in any way that is unlawful, harmful or disruptive, including but not limited to:

Attempting to gain unauthorised access to any part of the website or its underlying systems
Transmitting any unsolicited commercial communications or malicious code
Scraping, harvesting or otherwise extracting data from the website for commercial use
Using the website in a way that infringes the rights of any third party

We reserve the right to suspend or restrict access to the website at any time and without notice where we believe these Terms are being breached.

Links to third-party websites

Our website may contain links to third-party websites. These links are provided for your convenience only. Exponential Leadership has no control over the content or privacy practices of those websites and accepts no responsibility for them. The inclusion of a link does not imply our endorsement of the linked website.

Website availability

We aim to keep the website available and accurate but cannot guarantee uninterrupted access. We reserve the right to modify, suspend or withdraw the website or any part of it at any time without notice.

Limitation of liability

Exponential Leadership's services are designed to support your professional development and organisational effectiveness. The outcomes of coaching, leadership development and facilitation depend on many factors, including your engagement with the process, the context of your organisation and circumstances beyond our control. We cannot guarantee specific outcomes.

To the fullest extent permitted by applicable law, Exponential Leadership's total liability to you arising out of or in connection with our services or these Terms — whether in contract, tort (including negligence), breach of statutory duty or otherwise — is limited to the total fees paid by you for the specific service giving rise to the claim in the 12 months preceding the claim.

Exponential Leadership shall not be liable for any indirect, consequential, special or incidental loss or damage, loss of profit, loss of business, loss of data or loss of reputation, arising out of or in connection with our services, even if we have been advised of the possibility of such loss.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited by Dutch law. Your statutory rights as a consumer are not affected.

Data Protection and Privacy

Exponential Leadership takes the protection of your personal data seriously. Our Privacy Policy sets out in full how we collect, use, store and protect your personal data and your rights in relation to it under the GDPR. The Privacy Policy is available on our website and is incorporated into these Terms by reference.

Professional Standards and Ethics

Exponential Leadership operates in accordance with the professional ethics codes of the International Coaching Federation (ICF), the European Mentoring and Coaching Council (EMCC) and the Association for Coaching (UK). These codes govern our conduct in coaching relationships, including our obligations with respect to confidentiality, competence, conflict of interest and the welfare of clients.

If you have a concern about the conduct of an Exponential Leadership coaching engagement, we ask that you raise it with us directly in the first instance at info@exponentialleadership.net Where a concern relates to a potential breach of professional ethics, you also have the right to raise it with the relevant professional body.

Changes to these Terms

We may update these Terms from time to time to reflect changes in our services, applicable law or best practice. The date of the most recent update is shown at the bottom of this page. Where changes are material, we will notify existing clients by email.

Your continued use of our website or services after the publication of updated Terms constitutes your acceptance of those updates. If you do not agree with the updated Terms, please contact us to discuss or cease using our services.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any dispute arising out of or in connection with these Terms or our services that cannot be resolved by good-faith discussion between the parties shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.

Before initiating any formal dispute process, we ask that you contact us directly. Most concerns can be resolved quickly and without the need for formal proceedings.
